Platform Terms & Policies

These Platform Terms & Policies (“Terms”) govern your access to and use of WURKSPACE (“WURKSPACE”, “Platform”) at wurkspace.in and related services operated by Habitat Design and Arts Pvt. Ltd., New Delhi, India (“Habitat”, “we”, “us”). This is a single consolidated document — by creating an account, subscribing to a paid plan, or otherwise using WURKSPACE, you agree to every section below.

WURKSPACE is a workplace intelligence platform combining knowledge management, material intelligence, planning, and workspace collaboration. It is a decision-support product; you remain responsible for procurement, engineering, regulatory, and business decisions taken with it.

You must be at least 18 years old and legally able to enter contracts. You are responsible for the confidentiality of your credentials and for every action taken through your account. Workspace owners administer membership, roles, billing, and data within their workspaces; members inherit the workspace’s plan entitlements.

Organizations may operate multiple workspaces under a single billing entity. Workspace administrators are responsible for the lawful invitation and management of members.

WURKSPACE is offered in four tiers: Free, Professional, Team, and Enterprise. Each tier has published entitlements — seats, storage, AI credits, and feature access — visible on the pricing page. Entitlements apply per workspace unless explicitly stated otherwise.

We may revise plan features, limits, and pricing. Material adverse changes to a plan you currently pay for take effect at your next renewal, with advance notice by email or in-product notification.

Prices are displayed in Indian Rupees (INR) by default, with USD, AED, GBP, and SGD available for reference. Billing is charged in the presentment currency where supported; otherwise INR at prevailing conversion. Subscriptions are billed in advance on a monthly or annual cycle and renew automatically until cancelled. Annual plans are non-refundable except where required by law.

Applicable taxes (including GST for Indian customers) are added at checkout. Registered businesses may add a GSTIN for compliant tax invoices. Invoices are available in the workspace billing settings.

Cancellations: you may cancel any time from billing settings. Access continues until the end of the paid period; no partial refunds are issued for unused time on monthly plans. Downgrades take effect at the next renewal.

Failed payments: we retry charges for up to 14 days. Workspaces in dunning move to a read-only state before eventual downgrade to Free.

The Founding Member program offers early adopters a locked introductory rate on Professional or Team plans, honored for a defined period from the date of first paid subscription. Founding rates apply to the initial workspace only, do not transfer to other workspaces, and are non-stackable with other promotions. Habitat may close the program at any time; already-enrolled members keep their locked rate for the promised duration.

Add-ons (extra seats, storage, AI credits, dedicated inbound domains, premium support) are billed alongside the base subscription and prorated on the current billing cycle. AI credit packs are consumable, do not expire during an active subscription, and are non-refundable once consumed. Overages beyond plan entitlements are either blocked or billed transparently depending on the resource; the applicable behavior is stated on the pricing page.

You agree not to:

• use WURKSPACE to violate any law, regulation, or third-party right;
• upload malware, illegal content, or content you do not have the right to share;
• attempt to breach isolation between workspaces, tenants, or accounts;
• reverse-engineer, scrape, or benchmark the platform to build a competing product;
• abuse AI features to generate misleading, deceptive, or harmful content;
• resell WURKSPACE access without a written reseller agreement.

We may suspend or terminate workspaces that violate these rules, with notice where practicable.

You retain ownership of the content you upload to WURKSPACE (documents, drawings, images, project data). You grant Habitat a limited license to host, process, back up, and display your content solely to operate the service for you and your workspace. Workspace content is private by default and is not used to train third-party foundation models.

Aggregated, de-identified usage statistics may be used to improve the platform. Where you explicitly opt in to community or marketplace features, only the content you designate as public becomes discoverable.

WURKSPACE uses AI models — including large language, vision, and embedding models — to power features such as extraction, summarization, planning assistance, reply drafting, and knowledge search. AI outputs are probabilistic and may be incomplete, out of date, or inaccurate. Review AI outputs before relying on them for procurement, engineering, financial, or regulatory decisions.

Prompts and workspace content sent to model providers are processed under contractual data-protection terms and are not used by those providers to train public models. AI usage is metered in credits per plan.

We process personal data to operate WURKSPACE, authenticate users, provide support, prevent abuse, and comply with law. Categories include account data (name, email, workspace role), workspace content you upload, and usage telemetry. Our lawful bases are contract performance, legitimate interest, and — for optional features — consent.

You may access, correct, export, or delete your personal data from your account settings, or by writing to ajay@hdadelhi.com. Data is stored in secure managed infrastructure with region-appropriate residency. Retention is aligned with active subscription plus a reasonable wind-down window; you may request accelerated deletion.

We do not sell personal data. Sub-processors (hosting, model providers, email delivery, analytics) are listed on request and are contractually bound to equivalent protections.

WURKSPACE uses strictly-necessary cookies for authentication and session integrity, preference cookies to remember settings, and privacy-preserving analytics to understand product usage. We do not use advertising or cross-site tracking cookies. You can control cookies from your browser; disabling strictly-necessary cookies will prevent you from signing in.

We operate WURKSPACE with row-level security, encrypted transport and at-rest storage, role-based access control, audit logging for privileged actions, and least-privilege internal access. You are responsible for using strong passwords, enabling multi-factor authentication where offered, and managing membership of your workspace. Report suspected vulnerabilities to ajay@hdadelhi.com.

WURKSPACE, including its software, design, brand, and documentation, is the property of Habitat and its licensors. Nothing in these Terms transfers ownership of the platform to you. You may use the platform only under the license granted in your active plan. Feedback you provide about the product may be used by Habitat without obligation.

WURKSPACE integrates with third-party services (email providers, payment processors, model providers, calendar services). Your use of those services is governed by their own terms. We are not responsible for the acts, omissions, or content of third parties.

WURKSPACE is provided as is and as available. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI outputs will be accurate.

To the maximum extent permitted by law, Habitat’s aggregate liability arising out of or relating to these Terms will not exceed the fees you paid for the affected workspace in the twelve (12) months preceding the event giving rise to the claim. In no event will Habitat be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.

You will defend, indemnify, and hold Habitat harmless from claims, damages, and expenses arising out of your content, your use of WURKSPACE in violation of these Terms, or your violation of any law or third-party right.

You may terminate by cancelling all subscriptions and deleting your workspaces. We may suspend or terminate access for material breach of these Terms, non-payment, or where required by law. On termination, we will make workspace content available for export for a limited period before deletion.

We design WURKSPACE to be usable by people with a wide range of abilities and aim for WCAG 2.1 AA-level conformance across core flows. Report accessibility issues to ajay@hdadelhi.com and we will prioritize remediation.

We may update these Terms from time to time. Material changes will be announced in-product or by email at least 14 days before they take effect. Your continued use of WURKSPACE after the effective date constitutes acceptance of the updated Terms. Prior versions are archived and available on request.

These Terms are governed by the laws of India. The courts of New Delhi have exclusive jurisdiction, without prejudice to any statutory rights available to consumers in their country of residence.
